These Terms & Conditions ("Terms") govern your use of Keens Academy ("Keens", "we", "us"), including the website at keensacademy.com and all related services, courses, assessments, and reports. By using the service, you agree to these Terms.
1. Agreement
By creating an account, completing a purchase, or otherwise using Keens, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the service.
2. Eligibility
You must be at least 13 years old to use Keens. If you are under 18, you must have permission from a parent or legal guardian, who must agree to these Terms on your behalf. By using the service, you represent that you meet these requirements.
3. Your account
You are responsible for the information you give us and for all activity under your account. Keep your password confidential, and tell us immediately if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.
4. The service
Keens offers K-pop training assessments, online lessons, written feedback, and related products. Specific features, prices, and turnaround times are described on the relevant product page at the time of purchase. We may change, suspend, or discontinue parts of the service at any time.
5. Payments and refunds
- Pricing. Prices are listed in U.S. dollars unless stated otherwise and may change. The price you see at checkout is the price you pay.
- Payment. Payments are processed by our payment partner (Stripe). By submitting payment information, you authorize us to charge the listed amount.
- Subscriptions. If you purchase a recurring plan, it renews automatically until canceled. You can cancel any time before the next billing date in your account settings.
- Refunds. Monthly training plans include a 14-day full refund from the date of purchase, no questions asked. One-time products (such as the Level Check report) are non-refundable once a report has been delivered, except where required by law. To request a refund, email help@keensacademy.com.
- Taxes. Prices may not include applicable taxes; you are responsible for any taxes associated with your purchase.
6. Your submissions
You may submit videos, photos, audio, written answers, and other content to receive feedback ("Submissions"). You keep ownership of your Submissions. By submitting, you grant Keens a worldwide, non-exclusive, royalty-free license to host, store, evaluate, and process your Submissions for the purpose of providing the service.
If we want to use a Submission for marketing or public promotion (for example, a testimonial or social post), we will ask for your separate written permission first.
You represent that you have all the rights needed to submit the content and that your Submissions don't infringe anyone else's rights.
7. Intellectual property
Keens, our logos, course materials, reports, methodology, scoring rubrics, and the look and feel of the site are owned by Keens Academy and protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to access and use the service for your own training. You may not copy, redistribute, or resell our content, or use it to train competing products, without our written permission.
8. Acceptable use
You agree not to:
- Use the service to break the law or infringe anyone's rights.
- Share your account or resell access.
- Upload malware, attempt to disrupt the service, or probe its security without authorization.
- Scrape, copy, or systematically extract content for use outside the service.
- Submit content that is defamatory, obscene, hateful, or violates someone's privacy.
- Misrepresent who you are or impersonate someone else.
9. Disclaimers
Keens is a training and assessment service. We do not guarantee any particular outcome — including, but not limited to, an audition, agency offer, debut, or career in K-pop. Reports and feedback reflect the professional opinion of our trainers based on the materials you submit; they are not a contract, recommendation letter, or representation agreement.
The service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law. We don't warrant that the service will be uninterrupted, error-free, or meet every expectation.
10. Limitation of liability
To the maximum extent permitted by law, Keens, its officers, employees, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any lost profits or revenues, arising out of or relating to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid Keens in the 12 months before the claim arose.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold Keens harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the service, your Submissions, or your breach of these Terms.
12. Termination
You can stop using Keens at any time and close your account by emailing us. We can suspend or terminate your access if we reasonably believe you have violated these Terms or if needed to protect the service or other users. Sections that by their nature should survive termination — including ownership, disclaimers, liability limits, and governing law — will remain in effect.
13. Governing law
These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the courts of Seoul, Republic of Korea, except where applicable law gives consumers the right to sue in their place of residence.
14. Changes to these terms
We may update these Terms from time to time. Material changes will be announced on this page and, where appropriate, by email. The "Effective" date above shows when the Terms were last revised. Continued use of the service after a change means you accept the updated Terms.
